Terms & Conditions

This page (together with any documents referred to on it) tells you the terms and conditions (Conditions) on which we supply any of the goods (Goods) listed on our website www.sureblinds.com (our website), including any made-to-measure or custom-made Goods (Bespoke Goods). These Conditions, together with our Privacy and Cookies Policy, shall govern any contract for the supply of Goods listed on our site which is made at a distance between us and any customer (you and your) by any method, including telephone and also via our website.

It is important to read and understand these Conditions before placing your order.

By placing your order, you agree to be bound by these Conditions.

1. Information about us

1.1 SureBlinds.com is an online retailer of made to measure window blinds, shades and shutters. Our aim is to make window blinds accessible to the masses at affordable rates and with limited hassle.

2. Our contract with you and our products

2.1 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. You should always check the email we send you to make sure it contains all the correct information and notify us immediately if you need to amend anything on it.

2.2. If we are unable to accept your order, we will inform you of this in writing and will refund the online order or find a like for like product with the customers agreement. This might be because, for example, the product (or parts needed for the product) is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

2.3. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

2.4 While we primarily sell to customers in Nigeria we do also accept orders from outside Nigeria

2.5 You are responsible for providing us with accurate measurements for the Goods which you wish to purchase. If you need guidance on how to take the required measurements accurately, please contact our customer services team and we will be pleased to help you. Alternatively, please see the measuring guides.

2.6 We are sure you understand that we cannot accept the return of the Goods if the measurements you have provided to us are incorrect as we are unlikely to be able to resell them.

2.7 Material finishes and product colours shown on our site are for illustrative purposes only and can vary when viewed on differing computer equipment. For this reason, we cannot guarantee that your computer monitor will accurately reflect the true colour and finish of the Goods.

2.8 Whilst every effort is made by us to ensure that Goods sold and delivered to you match in every respect any sample or description we may have shown or given or sent to you, a minor or immaterial variation or change in colour or pattern between the sample or description and the Goods delivered shall not entitle you to reject the Goods nor to claim any compensation for such variation or change.

3. Your rights to make changes

3.1 If you wish to make a change to the product you have ordered please contact us without delay. Please note that we aim to start work on each order received within 1 hour of receipt so any changes you wish to make must be communicated to us as soon as possible – see clause .1 above. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract (see clause 8 – Your rights to end the contract).

4. Delivery of Goods

4.1 Delivery charges and estimated timescales are detailed in this website and when you place your order. We make every effort to deliver your order within the estimated timescales communicated to you and in any event within 30 days of the date of order (with the exception of Shutters). However postal delays are occasionally inevitable due to unforeseen factors.

4.2 We reserve the right to increase the delivery costs from those advertised on the Delivery Information page on our website from time to time to ensure that our costs are duly covered for any deliveries deemed unusual in the normal course of our business (for example, to any particular location or if the size or weight of the delivery is particularly large).

4.3 Made-to-measure manufacturing process. We will begin the manufacture of your made-to-measure product approximately one hour after accepting your order

4.4 We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

4.5 All Goods are offered by us subject to availability and we reserve the right to cancel any order placed by you if we have insufficient stock to deliver the Goods you have ordered.

4.6 We will deliver the Goods ordered by you to the address you give us for delivery when you place your order. It is your responsibility to ensure that the delivery address is accurate and complete; you must also ensure that there will be somebody to sign for and take delivery of the Goods upon delivery.

4.7 Any attempted delivery which is refused at the delivery address or which, through no fault of our own, cannot be delivered at the delivery address, will be returned. Up to two attempts will be made to re-deliver the Goods without charge; any subsequent attempt to re-deliver the Goods may be chargeable. The amount of the re-delivery charge depends on the carrier used to effect re-delivery.

4.8 Risk of loss or damage to the Goods will pass to you on the date when the Goods are delivered to you or on the date of first attempted delivery by us. Title to the Goods will pass to you at the same time, provided that we have at that time received payment in full for the Goods.

4.9 You should not book a fitter to install the Goods until the Goods have been received by you and you have checked that there are no defects in the Goods and that all parts are present and complete.

5. Cancellation Rights and Returns

5.1 Where the goods are “made to measure” you shall have no right to amend or cancel your order, return the goods or seek any refund of the price paid by you from us. This is because when we receive your order, the manufacturing process begins immediately and the goods are manufactured to your exact specification,

6. Price and Payment

6.1 The price of the product (which includes VAT) will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the product advised to you is correct.

6.2 We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

6.3 Whilst we try to ensure that all prices on our site are accurate, errors may occur. If we discover an error in the price of Goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat your order as cancelled.

6.4 You must pay for the products in full before we dispatch them.

6.5 All prices are supply only and do not include installation.

7. Our responsibility for loss or damage suffered by you –

We will only be liable for:

7.1 losses that are caused as a result of any breach of Contract by us (up to the value of the purchase price of the Goods you purchased)

7.2 losses that are caused as a result of our negligence

We are not liable for any loss if :

7.3 any loss is not foreseeable. Losses are foreseeable if they could have been contemplated by both of us at the time that your order was accepted by us; or

7.4 any loss was caused by or contributed to by your breach of any of these Conditions; and

7.5 we will not be liable for any indirect losses which happen as a side effect of the main loss or damage, and which are not foreseeable by you and us (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time), however arising.

7.6 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the Contract that is caused by events outside our reasonable control.

7.7 If you are contracting as a business customer:

7.7a we will not be liable to you if any monies due from you to us have not been paid in full;

7.7b we will have no liability to you for any: consequential losses; loss of profits and/or damage to goodwill; economic and/or other similar losses; special damages and indirect losses; business interruption, loss of business, contracts and/or opportunity; and/or inconvenience, delay or loss of production.
